Thank you for selecting the Services of Albo App offered by Thinkersteps Technologies Private Ltd. This Agreement, including the Additional Terms below, is the entire agreement between you and Thinkersteps Technologies Pvt Ltd. (Albo) In order to use the full spectrum of Albo App Services, you need to register on the Albo App and provide us with accurate and complete information. You are also required to keep your accounts, details and contact information complete and updated at all times.The device on which you download Albo App and use during registration, shall become Your registered device and device details shall be stored by us. The moment You log into your Albo App You will be asked to allow Albo to send an SMS from the new device, after which the new device becomes the registered device. You will not be able to access your Albo App account using your previous device until you re-login and re-authorize yourself on that device. You are responsible for maintaining the confidentiality of any login information and secure access credentials associated with your Albo App account. Accordingly, you are responsible for all activities that occur under your account/is using your secure credentials and Albo App shall not be liable for any such change or action performed by using your secure credentials on Albo App Platform.

CONSENT TO USE DATA

In connection with your use of the Service and as part of the functionality of certain versions of the Services, you may wish to have backup of your complete data to your online account space attached with Albo central server. The Services are designed to allow you to access and download your transaction records and Account data through the Services, to allow Ablo App to access your transaction records and Account Data, and to allow Albo to sync and store your data on the Albo cerntral server. If you lose or forget your mobile device or found damage it will help to recovered from albo central server.

You agree that the Albo App in accordance with its Privacy Policy, collect and use your information and technical data and related information.
The Company may use information and data pertaining to your use of the Services for analytics, trends’ identification, and purposes of statistics to further enhance the effectiveness and efficiency of the Platform.
Subject to applicable laws, the Company may be directed by law enforcement agencies or the government and related bodies to disclose data in relation to Users in connection with criminal proceedings. You understand and agree that in such instances, the Company shall have the right to share such data with relevant agencies or bodies.

MAINTAINANCE OF RECORDS

You shall maintain the records of all payment transactions on the Platform independently of the Platform (by way physical copies et cetera) and the Company reserves the right to seek copies of such records for their own use including record keeping.

USE WITH YOUR MOBILE DEVICE

Use of these Services may be available through a compatible mobile device, Internet access and may require software. You agree that you are solely responsible for these requirements, including any applicable changes, updates and fees as well as the terms of your agreement with your mobile device and telecommunications provider. INTUIT MAKES NO WARRANTIES OR REPRESENTATIONS OF ANY KIND, EXPRESS, STATUTORY OR IMPLIED AS TO:

THE AVAILABILITY OF TELECOMMUNICATION SERVICES FROM YOUR PROVIDER AND ACCESS TO THE SERVICES AT ANY TIME OR FROM ANY LOCATION;
ANY LOSS, DAMAGE, OR OTHER SECURITY INTRUSION OF THE TELECOMMUNICATION SERVICES; AND
ANY DISCLOSURE OF INFORMATION TO THIRD PARTIES OR FAILURE TO TRANSMIT ANY DATA, COMMUNICATIONS OR SETTINGS CONNECTED WITH THE SERVICES.

Trial Version. If you registered for a trial use of the Services, you will have access to the Services for the specified period of the trial ("Trial Period"). You must decide to purchase a license to the Services within the Trial Period in order to retain access to any Content or data provided or created during the Trial Period. If you do not purchase a license to the Services by the end of the Trial Period, you will not be able to access or retrieve any of the data or Content you added to or created with the Services during the trial.

Eligibility-

By accessing Albo Service and Albo Platforms, You represent that:-

You are 18 years of age or older;
You are capable of entering into a contract /legally binding agreement;
You have the right, authority and capability to enter into this Agreement abiding by all the provisions of the “terms of use” of Albo Services.

Terms of Termination-

You agree that Albo at its sole discretion may terminate your contract without prior notice and restrict your access to Albo application if We determine that You have violated the terms of use and You consent that in case Albo suffers losses, not limited to monetary losses, due to Your actions, We can take injunctive relief or any other legal action as deemed necessary within the said circumstances and Albo is not liable for any loss to You due to termination.

Dispute, Governing Law & Jurisdiction -

This Agreement and the rights and obligations thereunder and the relations of the parties and all matters arising under or in connection with this Terms of Use, including the, validity, data safety performance or termination thereunder, shall be governed by and construed in accordance with the laws of the Republic of India. Subject to and without prejudice to the amicable settlement, the courts in Nagpur , Maharashtra shall have exclusive jurisdiction to try and adjudicate all matters arising in connection with your use of the Albo covered herein.

Disputes or differences or concerns if any should be raised within 30 days of happening or non-happening of an event related to Albo Services, except in case of unauthorised transactions on Your Albo, which shall be reported by you as soon as you identify the issue and investigation for such disputes is subject to terms of use of Albo.
